The 1986 Act Does Not Fully Protect the Pharmaceutical Industry

President Ronald Reagan signed the National Childhood Vaccine Injury Act (“1986 Act”) into law on November 14, 1986. How many people are even aware of this law or how it changed everything for the pharmaceutical industry?
Before the 1986 Act parents were suing pharmaceutical companies for vaccine injuries and winning lawsuits big time. It got to the point that the pharmaceutical manufacturers were losing money on vaccine manufacturing.
The pharmaceutical industry told congress that they would no longer make vaccines unless they were protected from liability for vaccine damages and deaths. Therefore, the government gave them exactly what they asked for by signing the 1986 Act into law.
Since then, we the taxpayers have paid for any damages caused by vaccines, in what is known as the National Vaccine Injury Compensation Program, aka “Vaccine Court.”
Before 1986, the CDC childhood vaccines schedule consisted of 24 doses from birth to 18 years old. Today, the CDC childhood vaccine schedule starts before birth by injecting pregnant mothers, while giving 74 doses to children from birth to 18 years old.
Supreme Court Ruled “Vaccines are Unavoidably Unsafe”
In 2011, Supreme Court Justices in Bruesewitz v. Wyeth LLC, stated in their ruling “Vaccines are Unavoidably Unsafe,” while ruling in favor of the vaccine manufacturer. This case gave pharmaceutical companies absolutely no incentive to make vaccines safer because they were fully protected from liability.
The financial and other information uncovered are key in a well-funded and highly orchestrated media campaign to drown out any, and all dissenting voices on the topic of vaccine safety, while labeling them “anti-vaxxers.”
Thus, the growing number of individuals, families, organizations and even countries expressing declining confidence in vaccine safety remains a thorn in the side of the government and Big Pharma.
However, the vaccine advocacy organizations cannot suppress the fact that the Vaccine Adverse Event Reporting System (VAERS), actually touted as “the nation’s frontline vaccine safety surveillance system,” represents only the tip of the vaccine injury iceberg, capturing as little as 1% of vaccine-related adverse events.
Let’s take a logical look at this. The Supreme Court is saying, “Vaccines are Unavoidably Unsafe.” However, the government is mandating them for all children to attend public school, while protecting the vaccine manufacturers from liability, and making the taxpayer pay.
Safeguards In The 1986 Act Few People Know
There are safeguards to the public that were originally written into the 1986 Act that few people are aware of; not even many attorneys are aware of these clauses. These little-known clauses and stipulations protect the public against harm and allows Big Pharma to be held liable for damages.
- Evidence of Fraud
- VAERS must be accurately maintained (never has been)
- Make product as safe as possible
- Plaintiffs may Opt-Out of vaccine court after 240 days and file a civil lawsuit.
Even some of the top law firms in the country are not aware of these hidden clauses in the 1986 Act. Much of this is coming to light now because of the Covid area and the mandated Covid shots.
Top Law Firm Goes After Gardasil Makers
In a recent interview on the Highwire this past week, Michael Baum, Esq. speaks about their firm’s lawsuit against Merck & Company for their Gardasil vaccine which has been linked to serious injuries. Robert Kennedy Jr. and the Children’s Health Defense are working on this case with the firm Wisner Baum.
The Gardasil vaccine was approved by the U.S. Food and Drug Administration (FDA) in 2006. Since hitting the market, however, thousands of adolescents and adults have reported serious and disabling side effects after receiving the HPV vaccine. The most prominent among these side effects is postural orthostatic tachycardia syndrome (POTS).
It seems that many who have been injured from this vaccine are adolescents who were very active athletes before getting the HPV injection. A great book, The HPV Vaccine on Trial is a shocking tale, detailing the crushing denial and dismissal of reports of injuries and deaths.
CA Bill Would Mandate HPV Vaccine for All Students
This past month in February 2023, California Assembly Bill 659 was introduced in Sacramento to require students entering the 8th grade to have the HPV vaccine. This would apply to students attending public and private schools in California.
Parents of children that have already been injured by the HPV vaccine are suing Merck are deeply concerned that other children will suffer similar consequences if they are mandated to get this shot in order to attend schools in California.
A California mother who’s formerly healthy active daughter who is now in a wheelchair said:
“This is not a vaccine that should be mandated. There is no evidence Gardasil will prevent cervical cancer in the long term; it is entirely theoretical, based on studies testing only surrogate endpoints (lesions), not cancer itself, and like any medical intervention, Gardasil has risks, and those risks can be devastating.”
The reason most people are unaware of this important information is because vaccine injuries and deaths information has always been censored from the public. You will never hear this information on mainstream News media or Big Tech social media.
Even with vast underreporting to VAERS, the National Vaccine Injury Compensation Program, funded with taxpayers’ money, has paid out $4.5 Billion dollars since 1988 to vaccine-injured individuals who have managed to prove, against great odds, their injury claims.
Over the past 3 years, with all these tyrannical health mandates, the time to “open up” vaccine safety to real scientific scrutiny and unbiased discussion is now. The blessing is that now all of this truth is finally coming out after 37 years.
